If your H-1B registration has been selected in the FY 2026 lottery, congratulations! This is a critical milestone in the employment-based immigration process. Now it's time to move forward with the next steps to ensure a timely and accurate petition filing.
At Delgado Law Group, we guide employers and foreign professionals through every phase of the H-1B process. Below is a breakdown of what happens after your registration is selected.
Step 1: Confirm Your Details
Once selected, the first step is to review and confirm key details with your immigration attorney. This includes:
-
Job title and offered wage
-
Worksite location(s)
-
Required education and experience
-
The beneficiary's immigration history and current U.S. status (if applicable)
Getting these details right up front ensures a smooth and compliant petition.
Step 2: Gather Supporting Documents
To prepare the full H-1B petition, the following documents will be required:
From the Employer:
-
Signed job offer letter
-
Detailed job description and duties
-
Company overview and materials (such as a brochure, website printout, or organizational chart)
-
FEIN (Federal Employer Identification Number) and recent financials (for smaller or newer businesses)
From the Foreign Worker (Beneficiary):
-
Valid passport
-
Degree certificates and academic transcripts
-
Credential evaluation (for foreign degrees)
-
Resume and letters of work experience (if applicable)
-
Current visa documents and I-94 (if in the U.S.)
We will provide a custom checklist tailored to your specific case.
Step 3: File the Labor Condition Application (LCA)
Before the H-1B petition can be filed, we must obtain a certified Labor Condition Application (LCA) from the U.S. Department of Labor. The LCA confirms that the employer will pay the prevailing wage and maintain proper working conditions. Processing typically takes 7 business days, so it's essential to begin early.
Step 4: Prepare and File the H-1B Petition
Once the LCA is certified, we will finalize the Form I-129 and assemble the full petition for submission to USCIS.
Important Deadline: USCIS will begin accepting petitions on April 1, 2025, and the filing window closes on June 30, 2025. All selected registrations must be filed within this timeframe. Need Help with Your H-1B Filing?
