What You Need to Know About the O-1 and O-2 Visas

Posted by Jacqueline Delgado | Dec 29, 2021

Most visas into the United States need some sort of U.S.-based sponsor unless the individual is planning to visit for tourism reasons. Visa sponsors can include a person, business, or school. Two types of visas that require a sponsor are the O-1 and O-2 visas. If you are considering seeking an O-1 or O-2 visa, it is important to speak with an experienced immigration attorney who can help you determine if you are eligible and can help you prepare the most effective application.

What are O-1 and O-2 Visas?

The O-1 Visa allows people of extraordinary ability to enter, live, and work in the United States for up to three years. Extraordinary ability or achievement in the sciences, arts, athletics, business, or education can be the basis for an O-1 Visa. An O-1 Visa can also be obtained if the applicant has a demonstrated record of achievement in movies or television and has received national or international recognition for their work.

O-2 Visas are reserved for individuals accompanying the O-1 Visa holder to assist in a specific event or performance. The application for an O-2 Visa must be linked with the application of the O-1 Visa artist or athlete. The O-1 and O-2 Visas are nonimmigrant visas; this means that they are meant for temporary stay in the United States. Immigrant visas are for individuals planning to stay and live in the United States permanently.

Who is Eligible for an O-1 Visa?

There are specific eligibility requirements for O-1 Visas. Only a small percentage of those who have risen to the top of their field or profession can be granted an O-1 Visa. An application must include a written advisory opinion from a peer group or individual attesting to the applicant's extraordinary abilities or achievement, along with other appropriate evidence.
